Journal Article 1403 09 03 <p>Telemedicine, as one of the emerging technologies in the healthcare domain, has revolutionized the provision of medical services. This technology utilizes advanced communication tools to enable consultation and treatment of patients without requiring physical presence in a clinic or hospital. The advent of new medical service delivery modes such as telemedicine has introduced changes that traditional legal frameworks are unable to adequately address. Although numerous laws, regulations, and legal texts are available in foreign countries, in Iran—considering the utilization of telemedicine in specialized virtual clinics in cooperation with medical universities—it appears necessary to fill the legislative and regulatory gaps and to analyze and clarify the legal aspects of these services. This is particularly crucial because providing services through telemedicine leads to extensive and sometimes complex relationships between patients and service providers. The present study examines the factors that influence the development of a legal culture concerning civil liability arising from telemedicine. The research method is descriptive-survey in terms of data collection. The findings indicate that the factors contributing to the establishment of a legal culture in the field of civil liability related to telemedicine include: the current use of telemedicine by physicians, physicians’ future intention to use telemedicine, physicians’ awareness of telemedicine utilization levels in leading countries, physicians’ opinions on the impact of telemedicine on diagnostic and treatment capabilities, physicians’ readiness to adopt telemedicine, physicians’ familiarity with the legal challenges of telemedicine, awareness of the responsibilities of other involved parties (such as software developers and service providers, hospitals, etc.) in telemedicine, physicians’ knowledge of existing laws related to telemedicine, and the medical community’s desire for the enactment of specific legislation concerning telemedicine.</p> <p>پزشکی از راه دور (تله مدیسین) به عنوان یکی از فناوری‌های نوین در حوزه سلامت، توانسته است انقلابی در ارائه خدمات پزشکی ایجاد کند. این فناوری با استفاده از ابزارهای ارتباطی پیشرفته، امکان مشاوره و درمان بیماران را بدون نیاز به حضور فیزیکی در مطب یا بیمارستان فراهم می‌کند. ورود چهره‌های نوین طبابت همانند تله مدیسین، باعث ایجاد تغییراتی شده که قوانین سنتی پاسخگوی آن‌ها نیست؛ البته درکشورهای خارجی، قوانین و مقررات و همچنین متون حقوقی متعددی می‌توان یافت ولی در ایران با توجه به بهره برداری از تله مدیسین در کلینیک‌های مجازی تخصصی با همکاری دانشگاه علوم پزشکی در نظام حقوقی ما نیز برطرف کردن خلأ قوانین و مقررات و تحلیل و تبیین مباحث حقوقی این امور نیز لازم به نظر می‌رسد زیرا ارایه خدمات از طریق تله مدیسین به روابط گسترده و بعضاً پیچیده بیماران و ارایه کنندگان این خدمات می‌انجامد. در پژوهش حاضر به عوامل موثر بر ایجاد فرهنگ حقوقی در زمینه مسئولیت مدنی ناشی از تله مدیسین (پزشکی از راه دور) پرداخته شده است. روش تحقیق به لحاظ روش گردآوری اطلاعات توصیفی-پیمایشی می‌باشد. در نهایت این نتیجه حاصل شده است که عوامل موثر بر ایجاد فرهنگ حقوقی در زمینه مسئولیت مدنی ناشی از تله مدیسین (پزشکی از راه دور) عبارتند از: استفاده از تله‌مدیسین توسط پزشکان، استفاده از تله‌مدیسین توسط پزشکان در آینده، آگاهی پزشکان از میزان استفاده از تله‌مدیسین در کشورهای پیشرو، نظر پزشکان در مورد تأثیر تله‌مدیسین بر قدرت تشخیص و درمان، آمادگی پزشکان برای استفاده از تله‌مدیسین، آشنایی پزشکان با چالش‌های حقوقی تله‌مدیسین، میزان آگاهی از مسئولیت‌های سایر اعضای دخیل (سازندگان و ارائه‌کنندگان خدمات نرم‌افزاری، بیمارستان و...) در پزشکی از راه دور، آگاهی پزشکان از قوانین موجود در زمینه پزشکی از راه دور، تمایل جامعه پزشکی به وضع قانون خاص در زمینه تله‌مدیسین.</p> https://www.jecjl.com/index.php/jecjl/article/download/122/127
