All these advancements are defined through interaction with human society. However, this interaction can be a source of both benefit and harm, which underscores the necessity of legal frameworks to regulate the relationships between robots and society. Civil liability is one of the most significant topics in civil law, particularly due to the conflict of individual rights in industrial societies. Robots are capable of interacting with humans across various domains, and such interactions create a context in which harm and benefit may arise. The discussion on civil liability stemming from robotic surgeries in medicine directs us toward a re-evaluation of traditional legal doctrines and invites a detailed analysis of the distinct and specialized elements of robotic and remote surgeries in medical contexts. This paper employs a descriptive-analytical method, and the author seeks to, alongside explaining the theoretical foundations governing the civil liability of surgical teams in robotic surgeries, distinguish between software and hardware malfunctions that disrupt surgical procedures and may result in harm to patients, potentially leading to their death. The paper further aims to delineate differentiated civil liability rules for surgical teams based on the consequences of each type of malfunction. It will be argued that the commission or omission of a harmful act by a robot entails liability, and depending on the case, the human agent shall be held accountable based on the “theory of respect” and obliged to compensate for the damage, as the robot lacks legal or natural personhood and cannot bear liability.</p> <p>فناوری رباتیک همواره در حال پیشرفت است و مزیت‌های گوناگونی را برای آینده بشر نوید می‌دهد. همه این پیشرفتها در تعامل با جامعه انسانی است که تعریف می‌شود. البته این تعامل می‌تواند منشأ سود و زبان باشد که از همین نقطه وجود قوانین برای تنظیم روابط ربات در جامعه ضرورت می‌یابد. مسئولیت مدنی از با اهمیت ترین مباحث حقوق مدنی است که به سبب تزاحم حقوق افراد در جوامع صنعتی از جایگاه مهمی برخوردار است. ربات‌ها در عرصه­های گوناگون قابلیت تعامل با انسان را دارند و همین تعامل بستر شکل گیری سود و زیان میان آن‌ها را فراهم می‌آورد. سخن از مسؤولیت مدنی ناشی از جراحی‌های روباتیک در امر پزشکی ما را بدین سمت رهنمون می‌کند که از رهگذر بازاندیشی در آموزه­های سنتی پیرامون این موضوع، مؤلفه­های افتراقی و تخصصی جراحی‌های روباتیک و از راه دور در امر پزشکی را واکاوی نماییم. این نوشتار به روش توصیفی- تحلیلی<strong> </strong>است و<strong> </strong>نگارنده می‌کوشد تا به موازات تبیین بنیانهای نظری حاکم بر مسؤولیت مدنی تیم جراحی در جراحی‌های روباتیک در خصوص اختلالات نرم افزاری و اختلالات سخت افزاری که روند جراحی را مختل ساخته و موجبات ایراد لطمه به بیمار را فراهم می‌آورد و چه بسا منتهی به مرگ بیمار گردد، قائل به تفکیک گردیده و به فراخور پیامدهای ناشی از هر یک از این اختلالات ضوابط افتراقی مسؤولیت مدنی تیم جراحی را تبیین نماید. وگفته خواهد شد؛ انجام یا ترک فعل زیان بار، توسط ربات مسؤلیت آور است، که حسب مورد، عامل انسانی بر اساس «نظریه احترام» محکوم وملزم به جبران خسارت می‌شود؛ زیرا ربات فاقد شخصیت حقیقی ویا حقوقی است و نمی‌تواند از عهده خسارت برآید.</p> https://www.jecjl.com/index.php/jecjl/article/download/191/119
