The strength of the family not only guarantees the social, cultural and moral health of the society, but also has a key position in the Islamic jurisprudential and legal system. Islamic teachings, especially the verses of the Quran and the narrations of the Infallibles (peace be upon them), have introduced the family as a solid foundation whose relations between its members should be regulated on the basis of affection, mercy and justice (Ansarian, 2011: 45). On the other hand, the Iranian legal system, which is based on Islamic jurisprudence, has formulated numerous principles in its civil laws and superior documents to support the strength of the family. However, given the emerging social challenges, including the increase in divorce rates, changes in gender roles, and influence from non-authentic cultures, examining the jurisprudential and legal foundations of family strength has become more important than ever.</p> <p>خانواده به‌عنوان کوچک‌ترین و درعین‌حال بنیادی‌ترین نهاد اجتماعی، نقش بسزایی در شکل‌گیری و پایداری جوامع انسانی دارد. استحکام خانواده نه‌تنها تضمین‌کننده سلامت اجتماعی، فرهنگی و اخلاقی جامعه است، بلکه در نظام فقهی و حقوقی اسلام نیز جایگاهی کلیدی دارد. آموزه‌های اسلامی، به‌ویژه آیات قرآن و روایات معصومین (علیهم‌السلام)، خانواده را بنیانی مستحکم معرفی کرده‌اند که روابط میان اعضای آن باید بر اساس مودت، رحمت و عدالت تنظیم شود (انصاریان، 2011: 45). از سوی دیگر، نظام حقوقی ایران که مبتنی بر فقه اسلامی است، در قوانین مدنی و اسناد بالادستی خود، اصول متعددی را برای حمایت از استحکام خانواده تدوین کرده است. بااین‌حال، با توجه به چالش‌های اجتماعی نوظهور ازجمله افزایش نرخ طلاق، تغییر در نقش‌های جنسیتی، و تأثیرپذیری از فرهنگ‌های غیراصیل، بررسی مبانی فقهی و حقوقی استحکام خانواده بیش از پیش اهمیت یافته است </p> https://www.jecjl.com/index.php/jecjl/article/download/196/141
