Journal Article 1404 02 02 <p>In the context of jurisprudential and legal challenges resulting from the outbreak of a pandemic and its impact on contracts, the primary aim and focus lie in establishing a fair balance between preserving the rights of the contracting parties and adapting to changing and unpredictable circumstances, in a way that aligns the legal and jurisprudential structures with the realities of sudden crises such as pandemics. This research is theoretical in nature and has been conducted using a descriptive–analytical method. The findings of the study emphasize the importance of reforming and adapting jurisprudential and legal institutions when facing unforeseen events and highlight the necessity of formulating practical rules to achieve justice and maintain contractual relationships under crisis conditions. The emergence and spread of sudden and unforeseeable pandemics have challenged jurisprudential and legal systems. Among the most fundamental issues is the lack of anticipation and theoretical deficiencies concerning relevant doctrines, which include remedial mechanisms such as termination, modification, and adjustment of contracts. Through the application of the doctrine of contract adaptation, it becomes possible to revise legal relations and align contractual provisions with the new circumstances.</p> <p>در زمینه چالش‌های فقهی و حقوقی ناشی از شیوع پاندمی و تأثیر آن بر قراردادها، زمینه و هدف اصلی برقراری توازنی عادلانه میان حفظ حقوق طرفین و تطابق با شرایط متغیر و غیرقابل‌پیش‌بینی است، به گونه‌ای که بتواند ساختار حقوقی و فقهی را با واقعیت‌های بحران‌های ناگهانی، همچون پاندمی، هم‌سو و هماهنگ سازد. این تحقیق از نوع نظری بوده و به روش توصیفی – تحلیلی صورت گرفته است. یافته‌های تحقیق بر اهمیت اصلاح و سازگاری نهادهای فقهی و حقوقی در مواجهه با رویدادهای غیرمترقبه تأکید کرده، و ضرورت تدوین قواعد راهگشا جهت تحقق عدالت و تداوم روابط قراردادی در شرایط بحرانی را برجسته می‌سازد. پیدایش و گسترش پاندمی‌های ناگهانی و غیرقابل‌پیش‌بینی، نظام‌های فقهی و حقوقی را به چالش کشیده است، در این میان، یکی از اساسی­ترین معضلات، موضوع عدم‌پیش‌بینی و نواقص نظریه‌های مربوط به آن است که شامل راهکارهای جبرانی مانند فسخ، اصلاح و تعدیل قرارداد می‌گردد، تا از طریق بهره‌گیری از نهاد «تعدیل قرارداد»، امکان تصحیح روابط حقوقی و همسویی مفاد آن با شرایط جدید فراهم آید.</p> https://www.jecjl.com/index.php/jecjl/article/download/220/139
