Journal Article 1404/03/12 <p>The present study seeks to examine and identify the shortcomings in the implementation of the privatization law from a normative perspective and to evaluate their compatibility with the principles of the Iranian Constitution and authoritative jurisprudential sources. In recent decades, with governments shifting from a traditional public administration model toward the New Public Management (NPM) paradigm, privatization has emerged as one of its core principles. Privatization has been defined as an economic policy aimed at balancing governmental activities with those of other economic sectors, with the goal of fostering conditions of perfect competition and achieving greater economic and social efficiency. Its objective is to minimize the government’s continuous and ongoing activities. Given the implementation of four development programs since the Iranian Revolution, the question arises as to what measures should be considered in privatization so that, alongside realizing its intended objectives, the negative consequences of its implementation can be reduced to the lowest possible level.</p> <p>پژوهش حاضر در صدد بررسی و شناسایی آسیب‌های اجرای قانون خصوصی سازی از  بعد هنجاری و انطباق آن‌ها با اصول قانون اساسی و منابع معتبر فقهی است. در دهه‌های اخیر با تغییر رویکرد دولت‌ها از الگوی مدیریت سنتی به سمت  مدیریت دولتی نوین خصوصی سازی از مهم ترین اصول محوری آن می‌باشد.خصوصی سازی به عنوان یک سیاست اقتصادی جهت تعادل بخشیدن میان فعالیت دولت‌ها با سایر بخش‌های اقتصادی، با هدف ایجاد شرایط رقابت کامل و حصول کارایی اقتصادی و اجتماعی بیشتر تعریف شده است و هدف آن به حداقل رساندن فعالیت‌های مستمر و مداوم دولت است. با توجه به اجرای چهار برنامه توسعه بعد از انقلاب، این سوال مطرح است که برای خصوصی سازی باید چه تمهیداتی در نظر گرفته شود تا بتوان در کنار تحقق اهداف آن پیامدهای منفی ناشی از اجرای آن به حداقل ممکن برسد.</p> https://www.jecjl.com/index.php/jecjl/article/download/341/220
