One of the key concepts presented in this domain is the “right to the city,” which refers to a set of citizens’ rights to equitable access to urban facilities, services, and opportunities. The realization of this right requires the existence of efficient legal and institutional structures capable of ensuring equal access to urban resources through the guarantee of the rule of law. In this context, vulnerable urban groups are among those most exposed to deprivation from urban rights due to economic, social, or physical conditions. The objective of this study is to examine the relationship between the right to the city, the rule of law, and the protection of vulnerable groups within Iran’s urban legal system. This research seeks to elucidate the conceptual dimensions of the right to the city, analyze the extent to which Iranian urban laws and regulations address the needs of vulnerable groups, and evaluate the role of the rule of law in safeguarding citizenship rights in urban spaces. The findings indicate that although principles such as social justice, equality of citizens, and support for disadvantaged groups have been emphasized in Iranian laws and legal documents, the fragmentation of regulations, weak enforcement mechanisms, and the absence of a coherent approach in urban policymaking have posed significant challenges to the effective realization of the right to the city for many vulnerable groups. Therefore, strengthening the rule of law in urban governance and reforming existing legal frameworks can play a crucial role in achieving urban justice and providing effective support for vulnerable populations.</p> <p>گسترش شهرنشینی در دهه‌های اخیر موجب شده است که شهرها به مهم‌ترین بستر زندگی اجتماعی و اقتصادی انسان تبدیل شوند و در نتیجه، حقوق و مطالبات مرتبط با زندگی شهری اهمیت روزافزونی پیدا کند. یکی از مفاهیم مهمی که در این زمینه مطرح شده، مفهوم «حق به شهر» است که به مجموعه‌ای از حقوق شهروندان در بهره‌مندی عادلانه از امکانات، خدمات و فرصت‌های شهری اشاره دارد. تحقق این حق مستلزم وجود ساختارهای حقوقی و نهادی کارآمدی است که بتوانند از طریق تضمین حاکمیت قانون، زمینه دسترسی برابر شهروندان به منابع شهری را فراهم سازند. در این میان، اقشار آسیب‌پذیر شهری از جمله گروه‌هایی هستند که به دلیل شرایط اقتصادی، اجتماعی یا جسمی بیش از سایرین در معرض محرومیت از حقوق شهری قرار دارند. هدف این پژوهش بررسی رابطه میان حق به شهر، حاکمیت قانون و حمایت از اقشار آسیب‌پذیر در نظام حقوق شهری ایران است. پژوهش حاضر تلاش می‌کند ضمن تبیین ابعاد مفهومی حق به شهر، میزان توجه قوانین و مقررات شهری ایران به نیازهای اقشار آسیب‌پذیر را مورد تحلیل قرار دهد و نقش حاکمیت قانون را در تضمین حقوق شهروندی در فضای شهری بررسی کند. یافته‌های پژوهش نشان می‌دهد که اگرچه در قوانین و اسناد حقوقی ایران اصولی همچون عدالت اجتماعی، برابری شهروندان و حمایت از گروه‌های کم‌برخوردار مورد تأکید قرار گرفته است، اما پراکندگی مقررات، ضعف ضمانت اجرا و نبود رویکرد منسجم در سیاست‌گذاری شهری موجب شده است که تحقق عملی حق به شهر برای بسیاری از اقشار آسیب‌پذیر با چالش‌هایی مواجه باشد. از این رو، تقویت حاکمیت قانون در مدیریت شهری و اصلاح چارچوب‌های حقوقی موجود می‌تواند نقش مهمی در تحقق عدالت شهری و حمایت مؤثر از اقشار آسیب‌پذیر ایفا کند.</p> https://www.jecjl.com/index.php/jecjl/article/download/538/320
