In Islamic jurisprudence and legal studies, there is also no consensus regarding its meaning; however, “privilege,” in the sense of exclusive entitlement, may be regarded as the most appropriate meaning of right. What attracts attention in all definitions is the exclusive attribution of “human beings” as “right-holders.” In all categories of rights, such as the right of custody, easement, usufruct, option, pre-emption, and similar rights, “right” is attributed to human beings. In modern law, animals are also considered to possess rights, and “animal rights” has become a common concept. The question is: what does “right” mean in the compound expression “animal right”? In response to this question, it should be stated that the use of the term right in animal rights is similar to its use in human rights. When one speaks of an animal right, it means that the animal also possesses that privilege. There is no obstacle to attributing rights to animals and considering animals as right-holders, whether from a lexical perspective, in terms of meaning, or with regard to the source of rights. This important point can be inferred and established from the perspectives of Islamic jurisprudence and international law.</p> <p>واژه‏ی «حق« در‌لغت و اصطلاح دارای معانی بسیاری است. در‌علم فقه و دانش حقوق نیز درباره‏ی معنای آن، وحدت نظر وجود ندارد ولی می‌توان امتیاز را که به معنای اختصاص است شایسته‏ترین معنای حق دانست. آنچه در همه تعاریف جلب نظر می‏کند، اختصاص «انسان» به عنوان «ذو حق» است. در همه‏ی اقسام حق مانند حق حضانت، ارتفاق، انتفاع، خیار، شفعه و امثال آنها «حق» به انسان نسبت داده می‏شود. در حقوق جدید، حیوانات نیز برخوردار از حق شمرده شده‏اند و «حق حیوان» یک مفهوم رایج شده است. پرسش این است که در ترکیب «حق حیوان»، حق به چه معنا است؟ در پاسخ به این پرسش باید چنین گفت که کاربرد حق در حقوق حیوانات، همچون حقوق انسان هاست و زمانی که سخن از حق حیوان می‌شود، بدین معنی است که حیوان نیز دارای آن امتیاز است و هیچ گونه منعی برای انتساب حق به حیوان و صاحب حق شمردن حیوان چه به لحاظ لغوی و چه به لحاظ معنا و یا منشأ حق وجود ندارد که این مهم از منظر فقه اسلامی و حقوق بین المللی قابل استنباط و اثبات است.</p> https://www.jecjl.com/index.php/jecjl/article/download/545/379
