This study examines the objectives behind the establishment of such an obligation and analyzes the nature and legal rules governing the Certificate of Non-Reconciliation. Using a descriptive-analytical method, the study addresses the historical background and contextual foundations, the legal status and nature of the Certificate of Non-Reconciliation, as well as the procedure for obtaining, using, or withdrawing from the certificate. The requirement to obtain a Certificate of Non-Reconciliation is intended to place the process of divorce under supervision and regulation. A husband or spouses for whom the certificate has been issued may withdraw from proceeding with the divorce after obtaining the certificate, and obtaining the certificate does not create a mandatory obligation to finalize the divorce, even in cases where the certificate has been issued based on a consensual divorce and the wife subsequently withdraws her consent to the divorce.</p> <p>اخذ گواهی عدم امکان سازش قبل از طلاق در طلاق توافقی و طلاقی که به خواست زوج اتفاق می افتد تکلیفی است قانونی که توسط قانون گذار عرفی الزامی شده و سابقه فقهی ندارد؛ در این پژوهش به این موضوع پرداخته شده است که هدف از وضع چنین تکلیفی چیست و ماهیت گواهی عدم امکان سازش و احکام آن کدام است. بنابراین به شیوه توصیفی و تحلیلی به بیان سابقه و زمینه تاریخی، جایگاه حقوقی و ماهیت گواهی عدم امکان سازش و نیز نحوه دریافت و استفاده یا انصراف از گواهی پرداخته شده است. لزوم اخذ گواهی عدم امکان سازش جهت تحت نظارت در آوردن و مدیریت امر طلاق است. زوج یا زوجینی که گواهی بنا بر درخواست ایشان صادر شده میتوانند بعد از اخذ گواهی از انجام طلاق منصرف شوند و اخذ گواهی الزامی برای انجام طلاق ایجاد نمیکند حتی در موردی که گواهی بنا بر طلاق توافقی صادر شده و زوجه از طلاق پشیمان شود.</p> https://www.jecjl.com/index.php/jecjl/article/download/571/329
