Journal Article 1404/11/01 <p>The aim of this article is to identify the legal effects of the liberalization of low-risk narcotic drugs. In this regard, issues related to the subject, including the decriminalization of low-risk narcotic drugs, the grounds for the liberalization of low-risk narcotic drugs, the legal effects of the liberalization of low-risk narcotic drugs, and similar matters, were analyzed and examined. The findings of this study indicate that, first, the grounds for the liberalization of low-risk narcotic drugs may legally be justified based on the reduction of trafficking in industrial and high-risk narcotics, the prevention of case accumulation and prolonged judicial proceedings, labeling theory, and the enforcement of the principle of prioritizing more important laws as legal foundations for the decriminalization of low-risk narcotic drugs. Second, the decriminalization of low-risk narcotic drugs in many developed countries has led to a reduction in the tendency toward high-risk narcotic drugs and the harms arising from them. Third, if the liberalization of low-risk narcotic drugs is also implemented in Iranian law, it may prevent young people from gravitating toward industrial and high-risk narcotics, as well as the accidents and crimes resulting from hallucinations. This is because accident reports have repeatedly indicated that many incidents of murder, severe violence, and similar offenses have been caused by the consumption of industrial, psychoactive, and hallucinogenic drugs.</p> <p>هدف از این مقاله  شناسایی آثارآزادسازی مواد مخدرکم خطر از نظر حقوقی می باشد ودر این راستا مسایل مربوط به موضوع از جمله، جرم زدایی از مواد مخدر کم خطر، ادله آزادسازی مواد مخدر کم خطر، آثارآزادسازی مواد مخدرکم خطر از نظر حقوقی و موارد مانند آنهامورد تحلیل و کنکاش قرار گرفت و در نتیجه این مطالب استنتاج شد، اولاً، ادله آزادسازی مواد مخدر کم خطر: به نظر می رسد، کاهش قاچاق مواد مخدر صنعتی و پر خطر، عدم تجمیع پرونده و اطاله دادرسی، برچسب زنی، اجرای قانون اهم به عنوان مبانی حقوقی جرم زدایی از مواد مخدر کم خطر قابل استناد باشند. ثانیاً، جرم زدایی از مواد مخدر کم خطر در بسیاری از کشورهای توسعه یافته موجب کاهش گرایش به مواد مخدر پرخطر و آسیب های ناشی از آن شده است. ثالثاً، اگر در حقوق ایران نیز آزاد سازی مواد مخدر کم خطر انجام گردد می توان از گرایش جوانان به مواد مخدر صنعتی و پر خطر و حوادث و جنایتهای ناشی از توهم جلوگیری بعمل آورد. چراکه، در اخبار حوادث بارها عنوان شده که بسیاری از حوادث قتل و درگیری های شدید و مانند آنها به دلیل مصرف مواد مخدر صنعتی، روانگردان و توهم زا بوده است.</p> https://www.jecjl.com/index.php/jecjl/article/download/594/405
