Some scholars regard this form of liability as contrary to the principle of the personal nature of liability and, accordingly, have either opposed these institutions or treated them as exceptional. However, an analysis of the nature of liability in these institutions shows that such liability is a form of non-contractual civil liability. Moreover, in the laws of some countries, civil liability arising from the act of another has become an established principle. Although the legislator, in the Islamic Penal Code enacted in 2013, has confused the foundations and effects of the liability of the ʿāqilah with the liability of relatives, explaining the foundations of the civil liability of the ʿāqilah can contribute to the acceptance of the principle of non-contractual, and even contractual, civil liability in the Iranian legal system, which will be addressed in this study.</p> <p>در مواردی، به‌ تبع‌ فقه‌، در حقوق موضوعه‌، مسئولیتی‌ بر عاقله‌ یا بستگان یا نهایتاً بیت‌المال بار می‌گردد که‌ برخی‌، مسئولیت‌ مزبور را مخالف‌ اصل‌ شخصی‌ بودن مسئولیت‌ دانسته‌ و بنابراین‌ یا با این‌ نهادها مخالفت‌ شده و یا به‌ صورت استثنایی‌ با آن‌ها برخورد می‌گردد. در حالی‌ که‌ تحلیل‌ ماهیت‌ ضمان در این‌ نهادها، نشان می‌دهد که‌ ضمان مزبور، نوعی‌ مسئولیت‌ مدنی‌ غیرقراردادی است‌ و از سوی دیگر، در حقوق برخی‌ از کشورها، مسئولیت‌ مدنی‌ ناشی‌ از عمل‌ غیر، تبدیل‌ به‌ یک‌ اصل‌ شده است‌. اگرچه قانون‌گذار در قانون مجازات اسلامی مصوب 1392 دچار خلط مبحث در باب مبانی و آثار ضمان عاقله با مسئولیت خویشان شده است، لکن تبیین مبانی مسئولیت مدنی عاقله از موجبات پذیرش اصل مسئولیت مدنی غیرقراردادی و حتی قراردادی در نظام حقوقی ایران خواهد بود که بدان خواهیم پرداخت.</p> https://www.jecjl.com/index.php/jecjl/article/download/599/337
