<p>The protection of educational institutions during armed conflicts, beyond being an ethical imperative, constitutes a definitive and fundamental obligation within the frameworks of International Humanitarian Law and International Criminal Law. Its objective is to safeguard the right to education and the security of future generations under crisis conditions. Nevertheless, despite the explicit criminalization of intentional attacks against schools under Article 8 of the Rome Statute and the four Geneva Conventions, a profound gap exists between protective legal norms and realities on the ground. This discrepancy forms the central issue of the present study, as parties to conflicts frequently invoke flexible concepts such as military necessity or intelligence error in an attempt to justify attacks on such institutions and evade criminal responsibility. The necessity of this research stems from the fact that an incident such as the attack on the Minab School requires a precise legal examination in order to distinguish tactical errors from organized crimes and to clarify the evidentiary threshold of the mental element in aerial attacks. Accordingly, the principal research question is founded upon determining the legal criteria and constituent elements prescribed by the Rome Statute through which the attack on the Minab School may be identified as a war crime and attributed to the chain of command. Employing a descriptive-analytical methodology and a library-based research approach, this study examines the jurisprudence of the International Criminal Court and compares it with the objective data relating to the incident. The study reaches the key finding that, considering the civilian nature of the target and the use of weapons with disproportionate destructive capacity, the incident satisfies all material and mental elements of a war crime. The findings further indicate that, in the presence of advanced identification and surveillance technologies, claims of error lack legal credibility. Relying on the doctrine of command responsibility, the study concludes that the incident constitutes not merely a grave violation of humanitarian law but also a prosecutable crime, thereby underscoring the growing necessity of strengthening mechanisms for documentation and effective criminal accountability at the international level.</p>
