The medical system boards serve as venues for addressing patient complaints regarding damages caused by medical services. This review process generally involves receiving the complaint, examining documents, creating a case file, holding review sessions, and ultimately issuing a final ruling. The present study, conducted using a descriptive-analytical method through library research and note-taking, explores the procedures for handling claims and the basis for compensating damages according to medical system laws and regulations, as well as the specific conditions of each case. This process may include medical, legal, and social assessments of the damage to the patient, reviewing medical care standards, and comparing them to the actions taken. The outcome of this review may result in the approval or rejection of the patient's claim, as well as the obligation of the physician to provide compensation. However, the performance of these boards and the success rate of patients in obtaining compensation is an issue that requires further examination and evaluation.</p> <p>مسئولیت پزشکان در قبال خطای پزشکی یکی از قدیمی ترین موضوعات حقوق پزشکی است که به عنوان یک اصل پذیرفته شده، بیمار حق دارد از پزشک برای جبران خسارت به موجب قرارداد یا جرم واقع شده اقدام کند. هیات‌های نظام پزشکی مکانی برای رسیدگی به شکایات بیماران در مورد خسارت‌های ناشی از ارائه خدمات پزشکی هستند. این رسیدگی معمولاً با دریافت شکایت، بررسی مدارک، تشکیل پرونده، برگزاری جلسات بررسی و در نهایت صدور رای نهایی انجام می‌شود. تحقیق حاضر به روش توصیفی تحلیلی از طریق مطالعات کتابخانه‌ای و به صورت فیش برداری انجام شده است. روش‌های رسیدگی و مبنای جبران خسارت بر اساس قوانین و مقررات نظام پزشکی و شرایط خاص هر مورد متفاوت است. این فرآیند می‌تواند شامل ارزیابی پزشکی، حقوقی و اجتماعی خسارت وارده به بیمار، بررسی استانداردهای مراقبت پزشکی و مقایسه آن با عمل انجام شده باشد. نتیجه این رسیدگی می‌تواند منجر به تایید یا رد ادعای بیمار و همچنین الزام پزشک به پرداخت جبران خسارت شود. اما عملکرد این هیات‌ها و میزان موفقیت بیماران در دریافت جبران خسارت، موضوعی است که نیازمند بررسی و ارزیابی بیشتر است.</p> Civil liability compensation patient medical system boards مسئولیت مدنی جبران خسارت بیمار هیات های نظام پزشکی https://www.jecjl.com/index.php/jecjl/article/download/64/36
