This research was conducted using a descriptive-analytical method and a comparative legal approach. To achieve the research objectives, in addition to examining legal texts and international instruments, such as the International Covenant on Economic, Social and Cultural Rights, the library research method was used to analyze the content of documents, and secondary economic data analysis was employed to assess the degree of conformity between Iran’s national policies and international standards. The findings of the study indicate that although Iran has drawn on international human rights instruments in some dimensions when formulating supportive policies, it faces serious challenges in transferring concepts from the level of “general obligations” to “executive requirements” within its legal and economic system. The results show that the overlap between traditional structures of wealth distribution and modern human rights requirements has prevented the reproduction of poverty alleviation policies based on a rights-based approach, leading instead to a stronger emphasis on supportive and temporary approaches. Furthermore, the gap between international standards and domestic economic-legal capacities is among the main factors preventing the full realization of poverty alleviation objectives. The study concludes that the orientation of poverty alleviation policies in Iran requires a transition from a “supportive, needs-based approach” to a “legal, rights-based approach.” In order to align with international standards, human rights instruments must be integrated into Iran’s economic system not merely as political slogans, but as binding rules in the formulation of tax laws, social security systems, and wealth distribution policies. Moreover, strengthening supervisory mechanisms to monitor the realization of economic and social rights is one of the important strategies for reducing the effects of poverty in Iran.</p> <p>پژوهش حاضر با هدف تبیین چگونگی تأثیرگذاری اسناد بین‌المللی حقوق بشر بر جهت‌دهی به سیاست‌های فقرزدایی در سطوح ملی و بین‌المللی، با تمرکز ویژه بر بررسی وضعیت نظام حقوقی و اقتصادی ایران انجام شده است. این پژوهش با بهره‌گیری از روش توصیفی-تحلیلی و با استفاده از رویکرد حقوق تطبیقی انجام شده است. برای دستیابی به اهداف تحقیق، علاوه بر بررسی متون قانونی و اسناد بین‌المللی (مانند میثاق بین‌المللی حقوق اقتصادی، اجتماعی و فرهنگی)، از روش کتابخانه‌ای جهت تحلیل محتوای اسناد و همچنین تحلیل داده‌های ثانویه اقتصادی برای ارزیابی میزان انطباق سیاست‌های ملی ایران با استانداردهای بین‌المللی استفاده شده است. یافته‌های پژوهش نشان می‌دهد که اگرچه ایران در برخی ابعاد از اسناد بین‌المللی حقوق بشر در تدوین سیاست‌های حمایتی بهره گرفته است، اما در انتقال مفاهیم از سطح «تعهدات کلی» به «الزامات اجرایی» در نظام حقوقی و اقتصادی با چالش‌های جدی روبروست. نتایج حاکی از آن است که تداخل میان ساختارهای سنتی توزیع ثروت و الزامات مدرن حقوق بشری، مانع از بازتولید سیاست‌های فقرزدایی مبتنی بر حق (Rights-based approach) شده و بیشتر بر رویکردهای حمایتی و موقت تأکید دارد. همچنین، شکاف میان استانداردهای بین‌المللی و ظرفیت‌های اقتصادی-حقوقی داخلی، از عوامل اصلی عدم تحقق کامل اهداف فقرزدایی است. پژوهش نتیجه می‌گیرد که جهت‌دهی به سیاست‌های فقرزدایی در ایران نیازمند گذار از «رویکرد حمایتی-مبتنی بر نیاز» به «رویکرد حقوقی-مبتنی بر حق» است. برای همسویی با استانداردهای بین‌المللی، ضرورت دارد که اسناد حقوق بشری نه تنها به عنوان شعارهای سیاسی، بلکه به عنوان قواعد الزام‌آور در تدوین قوانین مالیاتی، نظام‌های تأمین اجتماعی و سیاست‌های توزیع ثروت در نظام اقتصادی ایران ادغام شوند. همچنین، تقویت مکانیزم‌های نظارتی برای پایش میزان تحقق حقوق اقتصادی-اجتماعی، از جمله راهکارهای مهم برای کاهش اثرات فقر در ایران است.</p> https://www.jecjl.com/index.php/jecjl/article/download/650/375
