An Analysis of Arbitration in Marital Disputes in Imamiyyah Jurisprudence
Keywords:
Arbitration, adjudication, family, jurisprudence, lawAbstract
When individuals become involved in legal disputes, they often regard recourse to judicial authorities as the first means of resolving their disagreements. However, the legislature has also provided alternative mechanisms intended to prevent unnecessary resort to the courts, reduce the volume of judicial cases, and expedite dispute resolution. One such mechanism is arbitration. In addition to regulating arbitration in civil disputes, the Code of Civil Procedure sets forth provisions concerning the qualifications of persons who may be appointed as arbitrators, the conditions governing arbitration, and the procedures through which disputes may be referred to arbitration.
