The Effects and Legal Rulings of Headship over the Family from the Perspective of Islamic Jurisprudence and Positive Law

Abstract

Headship over the family has consistently been one of the most contentious issues in the field of jurisprudence and law. This study seeks to answer the question of what the effects and legal rulings of male headship over the family are from the perspective of Islamic schools of jurisprudence. Jurists do not hold a unified view on this matter; some do not consider headship to constitute a ḥukm waḍʿī (declaratory ruling), while others believe that all the underlying rationales for legislative enactment are present in the institution of family headship, and that the Lawgiver has established it based on these rationales. From a legal standpoint, Article 1105 of the Civil Code refers to this rational principle, namely the headship of the man over the family. The methodology of this research is descriptive-analytical and is based on library sources. The findings indicate that although male headship over the family is recognized in Islamic jurisprudence, its scope varies across different schools, all of which emphasize the rational nature of this institution. Headship does not imply absolute domination but rather pertains to the preservation of the family’s best interests. Among the most significant effects of this headship are authorities related to the place of residence, the wife’s employment, maintenance (nafaqah), and travel.
