Abstract

The rapid expansion of artificial intelligence and its integration into governmental structures have raised new issues concerning the government’s liability for the potential damages caused by this technology. This study aims to analyze and examine the foundations and manifestations of the government’s civil liability for damages arising from artificial intelligence from the perspective of Islamic jurisprudence, seeking to provide a framework for governmental accountability in this emerging field. This research is theoretical in nature and was conducted using a descriptive–analytical method. In the present study, the principles of trustworthiness, honesty, impartiality, and originality of the work were observed. The government’s civil liability for damages caused by artificial intelligence can be identified in areas such as environmental damages, damages to cultural heritage, and damages related to judicial systems. The principles of justice, expediency, no-harm (La Zarar), and destruction (Itlaf) in Islamic jurisprudence, together with the theory of risk and the principle of full compensation for damages in law, provide strong foundations for the government’s civil liability regarding damages caused by artificial intelligence. These foundations oblige the government to prevent, supervise, and compensate for damages resulting from emerging technologies with the aim of guaranteeing citizens’ rights.
