A Comparative Study of the Criminal Policy of Iran and France in Preventing and Addressing Harms Arising from Genetic Technology

Abstract

The rapid advances in genetic technologies in recent decades have created extensive opportunities in the fields of medicine, agriculture, and biotechnology; however, these developments have simultaneously generated challenges and risks in ethical, social, and legal domains. The potential misuse of genetic data, unauthorized manipulation of the human genome, violation of genetic privacy, and unlawful applications of biotechnologies are among the harms that highlight the necessity of formulating and implementing appropriate criminal policies to prevent and address such risks. The present study aims to comparatively examine the criminal policy of Iran and France in preventing and addressing harms arising from genetic technologies. The research method in this study is descriptive-analytical and based on a comparative approach, and the required data were collected through library sources, legal documents, and relevant regulations. The findings indicate that, in the French legal system, due to the development of comprehensive regulations in the field of biomedicine and the establishment of supervisory and ethical mechanisms, a more coherent criminal policy has been formed regarding the control and prevention of genetic abuses. In contrast, although certain scattered regulations exist in related areas within the Iranian legal system, significant legislative and supervisory gaps are still observed in the criminalization and prevention of harms arising from genetic technologies. Based on the results of this study, drawing on the legislative and supervisory experiences of the French legal system can contribute to strengthening Iran’s criminal policy and establishing more effective legal frameworks for managing the risks associated with genetic technologies.
