The Legal Status of Sale Subject to Trial and Tasting under Islamic and Iraqi Law

Sale subject to trial and tasting is a form of conditional sale in Islamic jurisprudence whereby either the seller or the buyer stipulates the right to rescind the transaction after testing or tasting the subject matter of the sale. Owing to its relationship with the option of stipulation and the option of inspection, this type of sale occupies a distinctive position in Imami jurisprudence, Sunni jurisprudence, and Iraqi positive law. Using a descriptive–analytical method, the present study examines the nature, essential elements, and legal rules governing this contract in jurisprudential sources and the provisions of the Iraqi Civil Code. The findings indicate that Iraqi law, influenced by Imami and Hanafi jurisprudence, recognizes sale subject to trial and tasting and attaches specific legal effects and rules to it, although certain differences of opinion exist between the two legal systems regarding particular details. By analyzing the jurisprudential and legal foundations of this institution, the article also reviews the relevant research background and offers practical recommendations for the legal systems of Islamic countries.
