حقوق عصبی و محدودیت‌های نظارت کیفری: چالش‌های حریم خصوصی ذهنی در داده‌های نورالینک

چکیده

پیدایش فناوری‌های پیشرفته رابط مغز وکامپیوتر، به‌ویژه دستگاه‌های کاشتنی مانند نورالینک ، مرزهای حریم خصوصی و آزادی فردی را به طور بی‌سابقه‌ای جابه‌جا کرده است. این فناوری‌ها قادر به ثبت، ذخیره‌سازی و تفسیر حجم عظیمی از داده‌های عصبی هستند که مستقیماً شامل افکار، نیت‌ها و خاطرات فرد می‌شوند و قلمرو جدیدی به نام حریم خصوصی ذهنی/شناختی را ایجاد می‌کنند. مقاله حاضر به بررسی چالش‌های حقوقی نوظهور در خصوص استفاده از این داده‌های حساس در چارچوب نظارت کیفری می‌پردازد و استدلال می‌کند که قوانین سنتی حفاظت از داده‌ها در مواجهه با ماهیت عمیق و افشاگرایانه داده‌های عصبی نورالینک ناکارآمد هستند. هدف این پژوهش تبیین خلأهای قانونی و ارائه یک چارچوب حقوقی بدیل مبتنی بر حقوق عصبی است. که با روش تحلیلی-توصیفی، به تحلیل تزاحم میان منافع عمومی در مبارزه با جرم و حق بر تمامیت ذهنی و مصونیت از خود-انتساب اجباری می‌پردازد وسناریوهای نقض حریم خصوصی در صورت دسترسی غیرمقید مراجع کیفری به این داده‌ها را بررسی می‌کند. یافته‌های پژوهش نشان می‌دهد که حفاظت از حریم خصوصی ذهنی نیازمند شناسایی حقوق عصبی به عنوان حقوق بنیادین است.
