Neurolegal Rights and Limitations of Criminal Oversight: Challenges of Mental Privacy in Neuralink Data

The emergence of advanced brain-computer interface technologies, particularly implantable devices such as Neuralink, has redefined the boundaries of privacy and individual freedom. These technologies are capable of recording, storing, and interpreting vast amounts of neural data that directly encompass an individual’s thoughts, intentions, and memories, thereby establishing a new domain known as mental/cognitive privacy. This paper examines emerging legal challenges concerning the use of these sensitive data within the framework of criminal oversight, arguing that traditional data protection laws are ineffective in addressing the deeply revealing nature of Neuralink neural data. The aim of this research is to elucidate legal gaps and propose an alternative legal framework based on neurolegal rights. Employing an analytical-descriptive methodology, it analyzes the conflict between public interests in crime prevention and the right to mental integrity and protection from compelled self-incrimination, while examining privacy violation scenarios resulting from unregulated access to these data by criminal authorities. The research findings indicate that safeguarding mental privacy necessitates recognizing neurolegal rights as fundamental rights.
