Application of Restorative Processes in the Field of Corporate Crimes

Abstract

The paradigm of restorative justice, within a holistic approach, seeks to respond to the needs arising from the occurrence of crime. Various countries, by employing this approach in the context of corporate crimes and by expanding the concept of “restorative processes,” while engaging with actors who are generally rational and calculative, have identified the harms resulting from this category of offenses and, through responses such as compensation contingent upon suspension of punishment, correction of criminogenic conditions and practices, self-regulation, exemplary reparation, and community service, have formulated new criminal policy frameworks. The findings of this article, developed using a descriptive–analytical method, indicate that the criminal justice system of Iran, despite recognizing corporate criminal liability and restorative responses in the Islamic Penal Code and the Code of Criminal Procedure enacted in 2013, has not made significant use of empirical studies and field research from other jurisdictions in adopting restorative principles in addressing corporate crimes; therefore, there is a perceived need for legal reform and development in this area.
