کاربست فرایندهای ترمیمی در حوزه جرایم شرکتی

پارادایم عدالت ترمیمی در یک رویکرد کلنگرانه در پی پاسخ به نیازهای ناشی از وقوع جرم است. کشورهای مختلف با استفاده از این رویکرد در جرایم شرکتی و با گسترش مفهوم «فرایندهای ترمیمی» و مواجهه با کنشگران عموما سنجشگر و منطقی، آسیبهای ناشی از این دسته از جرایم را شناسایی کرده و با استفاده از پاسخهایی همچون جبران خسارت با شرط تعلیق مجازات، اصلاح موقعیت و رویههای جرمزا، خودتنظیمی، جبران خسارت تمثیلی و خدمات اجتماعی، سیاستهای کیفری جدیدی تدوین کردهاند. یافتههای این مقاله، که با روش توصیفی– تحلیلی نگارش یافته شده، حاکی از آن است که نظام عدالت کیفری ایران علیرغم به رسمیت شناختن مسئولیت کیفری شرکتها و پاسخهای ترمیمی در قانون مجازات اسلامی و قانون آیین دادرسی کیفری مصوب 1392، همچنان استفاده قابل اعتنایی از مطالعات میدانی و یافتههای تجربی سایر کشورها در اقتباس از آموزههای ترمیمی در پاسخ به مسأله جرایم شرکتی نکرده و در این زمینه نیاز به اصلاح و توسعه قوانین احساس میشود.
