تفکیک اراضی شهری یکی از موضوعات حیاتی در زمینه توسعه شهری و مدیریت اراضی است که با چالشهای متعددی مواجه است. این چالشها شامل تعارضات حقوقی و ثبتی، ضوابط و مقررات طرحهای جامع و تفصیلی، حقوق مالکانه و تملک دولتی، ضوابط و مقررات تفکیک اراضی، چالشهای اجرایی و عدم اطمینان در قوانین محلی است. این مقاله به بررسی این چالشها و اهمیت رعایت قوانین و مقررات مربوط به تفکیک اراضی شهری پرداخته و نیاز به یک رویه قضایی مناسب برای حل تضادها و تعارضات را تاکید کرده است. به علاوه، اهمیت سیاستهای جامع و هماهنگ برای بهبود قوانین و مقررات مرتبط، افزایش شفافیت و اطمینان در فرآیندهای تفکیک اراضی و ایجاد مکانیزمهای مناسب برای حل تضادها و تعارضات برجسته شده است. با در نظر گرفتن این مسئله، به بررسی چالشهای فراروی تفکیک اراضی شهری در قوانین و مقررات با تکیه بر رویه قضایی با روش تحلیلی – توصیفی و به صورت کتابخانه ای پرداخته می شود. یافتههای تحقیق نشان می دهد که برای دستیابی به یک فرآیند تفکیک اراضی شهری که هم قانونی و هم عادلانه باشد، همکاری بین سازمانهای دولتی، شهرداریها و مالکان اراضی ضروری است.
