Implications and Scope of Iran’s Accession to the Apostille Convention

Abstract

Accession to international conventions has diverse implications for the domestic legal systems of countries, making the analysis of such effects a necessity. Among these, Iran’s accession to the 1961 Hague Convention, which aims to facilitate the authentication process of foreign public documents, holds particular significance. This Convention seeks to eliminate superfluous authentication procedures and simplify the certification of public documents among member states to ease their transnational use. Accordingly, the objective of the present study is to answer the question: What is the necessity of Iran’s accession to the Apostille Convention? This research adopts a library-based (documentary) approach using card-indexing tools, and the method of analysis is descriptive–analytical. The findings indicate that upon accession to the Convention and the implementation of its regulations, certain provisions of Iranian law in interaction with member states have been implicitly repealed. Notably, this includes Paragraph 4 of Article 1295 and Article 1296 of the Iranian Civil Code, both concerning international legal relations. Furthermore, Article 2, Paragraph (a) of the Law on the Translation of Statements and Documents in Official Courts has also been affected. These changes aim to align national regulations with international norms and foster legal system integration. Iran’s accession to the said Convention, considering its substantial advantages, not only promotes foreign investment but also prevents foreign currency outflow related to document authentication. This measure, in light of national interests, is both beneficial and essential, and the process of joining this Convention ought to be pursued with greater speed and precision to fully realize its benefits.
